The Use of Scholarship by International Courts and Tribunals

This project is concerned with how judges in international courts and tribunals use scholarship (i.e. scientific texts in books and journals that say something about the content of international law).

About the project

The project is based on an empirical examination of the decisions of the International Court of Justice, the International Criminal Court, the International Tribunal for the Law of the Sea, and the World Trade Organization Appellate Body.

Objectives

The project has three aims:

  1. Measuring the impact of scholarship on how international judges decide cases and write opinions.
  2. Examining the other functions of scholarship in international adjudication.
  3. Recommending how international judges should use scholarship.

The thesis is to be submitted by the end of 2017.
