Bakgrunn
Cand.jur. 1981. Dr.juris. 1994 på avhandlingen “Styring av kompleksitet. Rettslige former for statlig rammestyring og desentralisert statsforvaltning” (publisert i 1996). Professor i offentlig rett 2002. Tilknyttet LOS-programmet (Ledelse, organisasjon og forskning) under Norges Forskningsråd 1988-1996. Medlem av styret i LOS 1993-96. Forsker på ARENA (Norges Forskningsråds program om europeisering av nasjonalstaten) 1996-97. Fremdeles tilknyttet programmet. Medlem av styret i ARENA 1993-95.Visiting fellow ved European University Institute 2001. Medlem av Regional etisk komité for medisinsk forskning (øst), 2001- . Byråsjef i Finansdepartementet 1985-86.
Forskningsfelt
Forsker tverrfaglig innenfor området offentlig rett på områder som berører forvaltningsrett, statsrett, EU-rett, miljørett, rettssosiologi og rettsteori. Doktoravhandlingen fra 1994/1996 handler om forvaltningspolitiske og organisasjonsrettslige endringer i statlig forvaltning i perioden 1985-94. Endringer er diskutert i forhold til mer langsiktete endringsprosesser eksemplifisert ved begrepene rettsstat, forvaltningsstat og nettverksstat og i forhold til teorier om prosedural og refleksiv rett. Etter dette har forskningen fordelt seg på følgende områder:
1) Utviklingen av offentlig organisasjonsrett med særlig vekt på bruken av statsselskaper og stiftelser knyttet til offentlig forvaltning, og utviklingen av lovgivningsformer mer generelt,
2) EU-rett med fokus dels på forholdet mellom handel og miljø og dels på hvordan forholdet mellom medlemsland og organisasjoner i EU og EØS kan beskrives rettslig og konstitusjonelt.
3) Forholdet til WTO og andre internasjonale organisasjoner og traktater er også etter hvert inkludert i dette, herunder studier av nye begreper som det transnasjonale og governance som betegnelser på internasjonale relasjoner.
4) Miljørett med fokus dels på reguleringen av bio- og genteknologi, herunder utviklingen av anvendelsen av føre-var-prinsippet, og dels på forholdet mellom handel og miljø.
5) Rettsteoretiske studier med utgangspunkt i de problemområder som er nevnt ovenfor. Det vil si studier av institusjonelle forandringer mellom offentlig og privat, mellom ulike lovgivningsformer og mellom det nasjonale, internasjonale og transnasjonale. Det dreier seg primært om nyere rettsteori som er institusjonelt, demokratiteoretisk og rettssosiologisk orientert: Niklas Luhmann, Gunther Teubner, Jürgen Habermas, Michel Foucault.
Internasjonalt samarbeid: Deltar i et prosjekt om ”Transnational governance and Constitutionalism” ved European University Institute, Firenze. Har et utstrakt forskningssamarbeid med flere forskere ved Handelshøjskolen i København og Universitetet i København.
