(1) The buyer may cancel the contract if the lack of conformity amounts to a fundamental breach of contract.
(2) The buyer may not cancel the contract unless he gives the seller notice of the cancellation within reasonable time after he was informed or ought to have been informed of the lack of conformity, or after the expiry of the period which may follow from a claim or notification under §§ 34 or 36 above. This rule does not apply however if the seller has been grossly negligent or otherwise acted in conflict with honesty and good faith.
