Ellen Eftestøl-Wilhelmsson
Bakgrunn
Ellen Eftestøl-Wilhelmsson tok sin cand. jur. grad i 1995, og sin juridiske doktorgrad i 2005, begge ved Universitetet i Oslo.
Hun har vært juniorstipendiat ved det juridiske fakultet ved Universitet i Bergen i perioden 1990-91, deltidsansatt på juridisk avdeling i Den norske Bank perioden 1991-92, og på justisdepartementets utlendingsavdeling perioden 1992 -93. I perioden 1995 - 2004 har hun jobbet som stipendiat ved Senter for Europarett ved Universitetet i Oslo, avbrutt av to barselpermisjoner. År 1999 - 2000 var hun sekretær for Center of International Economic Law ved Swedish School of Economics i Helsingfors, Finland. Fra 2004 har hun jobbet som forsker ved Nordisk Institutt for Sjørett. Hun har daglig kontorplass på Institute of International Economic Law (KATTI) ved Helsingfors Universitet, Finland.
Fra 1996 har hun utført ulike oppdrag som jurdisk ekspert, særlig innen handelsagentur.

The aim of this is study is to contribute to the ongoing discussion on carrier liability under a multimodal transportation contract within the European Union (EU) and the extended EEA (European Economic Area). The questions to discuss are whether or not a harmonized legal tool in this area is feasible and, if yes, what the content of the rules of such a legal instrument should (or could be).
At present the questions are discussed internationally within the framework of the UN, in the United Nations Conference on Trade and Development (UNCTAD) as well as in the United Nation Commission on International Trade Law, UNCITRAL. The latter has recently produced a Convention of the Carriage of Goods wholly or partly by sea; Rotterdam Rules (pdf). Also regionally, within the European Union, the questions on the liability of the carrier under a multimodal contract are on the agenda.
Supporting multimodal transport is a major part of the European Commission transport policy as laid down in the White Paper: “European Transport Policy for 2010: Time to decide”. In order to enforce the policy mentioned, several actions are discussed within the framework of the directorate General of Energy and Transport (DG TREN). One of the main areas is the question of carrier liability under multimodal contracts. As a starting point for the discussion a legal group of experts have drafted a set of uniform rules dealing with the questions of multimodal carrier liability. Apart from the discussion on the content of these rules, an important issue for the EU is of course whether or not the union should implement a regional legal instrument of its own, or wait until the international discussion leads to an international convention acceptable for the involved stakeholders. Looking at the history this might be an onerous task.
In order to have an opinion on where the community legislation in this area should head, it is crucial to be fully aware of where one stands at the moment. A core area of this study will be to provide information on this question through a comparative study of the national rules on carrier liability under a multimodal contract in three different legal systems within the EU/EEA; the German, the English and the Nordic.
The reason for picking these three legal systems among all the member states of the EU/EEA is that they represent important and different systems both from an economic as well as from a legal point of view. Germany has adopted an interesting legal instrument dealing with carrier liability under multimodal transport contracts. Experiences from this piece of legislation could be valuable in the discussions mentioned above.
Neither the Nordic countries nor England has any kind of specific legislation on the questions at stake. The starting point is the existing provisions on liability under unimodal transports. Representing two separate legal cultures, it is likely that the way the carrier liability question is solved in the two legal systems might differ both internally as well as from the German solution. The Nordic legal systems are highly influenced by English law as far as international transport is concerned. However, recent developments in Nordic law, such as the revision of the Nordic Maritime Codes in the 90ties, shows that the Nordic countries approach to the liability questions in some details differs from the English approach.
