Good enough reason?

Master thesis by Elise Gedde Metz on European Court of Human Rights and Norwegian Supreme Court cases on what is considered to be sufficient reasoning in jury cases. Read the thesis.

The question of the quality of jury reasoning in criminal cases has been the object of debates in several European countries, including Norway, the UK and France. It has also been the issue of an important judgment by the European Court of Human Rights (ECHR) in the case Taxquet v. Belgium (Chamber judgment in 2009, Grand Chamber judgment in 2010).

Metz' study illustrates how, in a specific case, the Norwegian Supreme Court is influenced by the ECHR, and how in turn the ECHR is influenced by reasing in decisions by national courts.
