The Human Rights Treaty Bodies and Legitimacy Challenges
This chapter by PluriCourts director Geir Ulfstein appears in the forthcoming book Legitimacy and International Courts (eds. N. Grossman, H.G. Cohen, A. Follesdal and G. Ulfstein), Cambridge University Press. Read the chapter on SSRN.
The United Nations human rights treaty bodies, such as the Human Rights Committee, the Committee Against Torture, and the Committee on the Elimination of Discrimination Against Women, oversee national implementation of international human rights obligations. In this chapter Ulfstein discusses the legitimacy of the human rights treaty bodies’ court-like function of deciding cases on individual complaints.
