 Sammendrag

Har troppebidragsytende stater i FN-autoriserte fredsoperasjoner, på grunn av deres militære styrkers deltakelse, rettslige forpliktelser etter Den europeiske menneskerettskonvensjonen overfor den sivile lokalbefolkningen? Dette er hovedspørsmålet i avhandlingen. Avhandlingen analyserer gjeldende rett på området, men tar også sikte på å plassere konvensjonen i en bredere rettslig og samfunnsmessig sammenheng som gir grunnlag for en kritikk av den tilnærmingen Den europeiske menneskerettsdomstolen (EMD) har tatt. For sammenlikningsformål diskuteres også anvendelsen av FN-konvensjonen om sivile og politiske rettigheter i tilsvarende ramme.

Et sentralt utgangspunkt for analysen er EMDs avvisningskjennelse i Behrami/Saramati-saken (2007), hvor EMD konkluderte med at FN var ansvarlig for handlinger begått av KFOR-styrker i Kosovo og at Domstolen derfor manglet jurisdiksjon til å vurdere saken. Avhandlingen beskriver at Domstolens tilnærming til spørsmålet er uheldig, men avgjørelsen må likevel anses for å gi uttrykk for gjeldende rett på sitt område. Avgjørelsen er likevel ikke uttømmende, blant annet fordi sentrale spørsmål om statsansvar ikke er drøftet, og den vil ikke helt utelukke at troppebidragsytende stater i senere saker kan holdes ansvarlig etter konvensjonen for handlinger begått av deres militære styrker i fredsoperasjoner.

Avhandlingens materielle hoveddel består av tre seksjoner. Først analyseres de to viktigste argumentene som kan begrunne at konvensjonen ikke er anvendelig i fredsoperasjoner, nemlig spørsmålet om hvem som er rett ansvarssubjekt, og spørsmålet om såkalt ekstraterritoriell anvendelse av konvensjonen. Analysen av disse to spørsmålene leder frem til en foreløpig konklusjon om at det er visse situasjoner hvor konvensjonen er rettslig bindende for militære styrker i fredsoperasjoner.

Dernest diskuterer avhandlingen ulike faktorer som kan modifisere eller utelukke anvendelse av konvensjonen, selv om den i prinsippet er anvendelig. Den første faktoren er at internasjonal humanitærrett kan måtte gis forrang fremfor internasjonale menneskerettigheter når styrkene er involvert i en væpnet konflikt. Den andre faktoren er at troppebidragsytende stater kan ha mulighet til å avgi reservasjoner eller derogasjoner med virkning for deltakelse i internasjonale fredsoperasjoner. Den tredje faktoren er at en resolusjon fra FNs Sikkerhetsråd kan ha forrang fremfor motstridende bestemmelser i konvensjonen. Den fjerde faktoren er at vanskelige rettslige utfordringer oppstår som en følge av at internasjonale fredsoperasjoner krever samarbeid mellom ulike stater med potensielt ulike rettslige forpliktelser.

Avslutningsvis diskuterer avhandlingen den konkrete anvendelsen av tre materielle regler på grunnlag av de foregående konklusjonene, nemlig retten til liv, forbudet mot tortur, og retten til frihet og sikkerhet.

Avhandlingen foreslår at hovedforklaringen på EMDs tilnærming i Behrami/Saramati-saken er at Domstolen mener at konvensjonen ikke er egnet for anvendelse i fredsoperasjoner. Avhandlingen identifiserer argumenter som kan tale for et slikt syn, men disse argumentene analyseres kritisk gjennom avhandlingen. Avhandlingen konkluderer med at anvendelse av konvensjonen er uhensiktsmessig bare så lenge EMD er uvillig til å gjøre visse unntak eller modifikasjoner i forhold til sin egen eksisterende rettspraksis. Avhandlingen foreslår en tilnærming til spørsmålet som ville føre til et klarere rettslig rammeverk for de militære styrkenes menneskerettighetsfunksjoner og til et sterkere ansvarsregime, uten å pålegge styrkene urealistiske eller uhensiktsmessige forpliktelser.

Summary

Do Troop Contributing States in UN-mandated peace operations, through the participation of their military forces, have legal obligations under the European Convention on Human Rights towards the local civilian population? This is the key issue in the dissertation. The dissertation discusses the current legal position (the lex lata) in this regard, but it also places the Convention in a wider legal and societal context which allows for a critique of the position taken by the European Court of Human Rights. For comparative purposes, the applicability of the International Covenant on Civil and Political Rights is also discussed in the same context.

An important starting point for the legal analysis is the Court’s inadmissibility decision in the Behrami/Saramati case (2007), where the Court held that the conduct of KFOR troops in Kosovo was attributable to the United Nations and that the Court therefore lacked jurisdiction to review the conduct. The dissertation describes that the Court’s reasoning is inappropriate, but it must be accepted as an expression of the lex lata with regard to attribution of conduct under the Convention during peace operations. However, the decision is not exhaustive since, inter alia, fundamental questions concerning State responsibility are not addressed, and it does not entirely exclude responsibility for Troop Contributing States under the Convention for the conduct of their military forces in peace operations.

The substantive part of the dissertation consists of three sections. First, it analyses the two main arguments for a total non-applicability of the Convention in peace operations, namely the issues of attribution and of extraterritorial application of the Convention. The analysis of these issues leads to a preliminary conclusion that there are certain situations where the Convention is applicable de jure to the conduct of military forces in peace operations.

Second, the dissertation discusses factors that may modify or exclude the application of substantive provisions in the Convention, even if the Convention as such is applicable. The first factor is that international humanitarian law may prevail over human rights law when the military forces are involved in an armed conflict. The second factor is the possibility of Troop Contributing States to make reservations or derogations with effect for the participation of its military forces in an operation. The third factor is the possible prevailing effect of the UN Security Council resolution over conflicting norms in the Convention. The fourth factor is that difficult legal challenges arise as a consequence of the fact that such operations involve the co-operation between different States with potentially different legal obligations.

Third, the dissertation describes the concrete application of three substantive norms on the basis of the foregoing conclusions, namely the right to life, the prohibition against torture, and the right to liberty and security.

The dissertation suggests that the main explanation for the Court’s approach in the Behrami/Saramati case is that the Court considers that it is inappropriate to apply the Convention in peace operations – that the Convention is a “square peg” that does not fit in the “round hole” of peace operations. The dissertation identifies arguments that support this view, but it examines the validity of these arguments and reaches a conclusion that an application of the Convention is inappropriate only as long as the Court refuses to make exceptions or modifications to its own previous case law. The dissertation proposes an approach that would lead to a clearer legal framework for the human rights functions of military forces and to a stronger accountability regime, while not placing unrealistic or inappropriate burdens on the forces.
