Andreas Føllesdal: International Human Rights as a Global Social Contract: Legality – Legitimacy - Effectiveness

International Legal Human Rights (IHR) are sometimes hailed as part of a ‘global social contract’. They have become well-near global standards of legitimate rule, not only as ideals of aspiration but as legal norms that have had some impact both within and among states even in the absence of international sanctions.

The puzzle underlying this focus is that the exalted status of IHR is poorly understood and may be unsustainable. Questions:

Under what conditions IHR can be implemented in national law, be regarded as normatively legitimate, and contribute effectively to solve major global challenges?
