International investment law and arbitration is the subject of growing empirical inquiry. Drawing on a wide range of disciplines and different qualitative, quantitative and computational methods, the research has shed light on burning public policy debates, puzzles in actor behavior, and trends in institutional and legal developments.

The conference is hosted by LEGINVEST, a Research Council of Norway-financed project, Pluricourts Centre of Excellence, Faculty of Law, University of Oslo in collaboration with iCourts and the German Development Institute

Doctoral Research Fellow Tarald Laudal Berge and professor Malcolm Langford comment on the negotiations over how to reform investor-state dispute settlement (ISDS) that took place under the auspices of the United Nations in Vienna last week. Almost 100 states were present to discuss the need to establish a new system for resolving disputes between multinational corporations and states.

The project's primary objective is to determine the relative importance of investment treaty arbitration (ITA) for the design of international investment agreements (IIAs) and the relative importance of (re)design of IIAs for ITA. Secondary objectives of the project are to:

1) Establish a general applicability database mapping the content of IIAs,

2) Propose ways to enhance synergies between international investment law and policies to protect the environment, promote human rights, and facilitate sustainable development in poor countries, and

3) Contribute to the general debate concerning the legitimacy of international courts with a comprehensive case study and a new analytical framework for assessing the relationship between the activities of courts and treaty design.

The project started in September 2018 and ends in August 2022.

PhD candidate Nicola Strain investigates whether the World Trade Organization Panels and Appellate Body and investor-state investment arbitrations have jurisdiction to decide questions of public international law when such issues arise in close connection with a dispute under the agreement conferring jurisdiction on the tribunal.
