The presentation focuses on how different theoretical and methodological choices shape what we can know about international law, particularly positivism contrasted with a more interactional understanding of international law. Drawing on her dissertation, where article 5 of ARSIWA served as an entry point, I discuss how theory and methodology shape what/how we can know about and international law, what criticisms can arise, and how to defend them.
The presentation highlights how the choice of a research design allow us to see, and unsee, international law (and the State) as objects of knowledge.
