Duration
18.09.2023–03.11.2027

The PhD project analyses Norwegian court rulings in custody disputes concerning issues of visitation rights involving allegations of violence and abuse. The aim is to identify how decision-makers determine and justify the best interests of the child while considering the parents' rights in the overall assessment.

About the project

There is a common perception among professionals working with custody disputes that involve allegations of violence and/or abuse that these are challenging cases. Custody disputes with such allegations raise numerous issues, which can be difficult for both the private parties and the professional actors involved. The child’s need for protection in custody disputes involving allegations of violence and/or abuse requires greater focus.

Goals

The primary objective of this thesis is to investigate and clarify the legal status in custody disputes involving claims of violence and abuse against children and/or parents. I will particularly focus on the issue of visitation rights and the assessment of evidence in these cases, in relation to the legislator's intent to protect the child from the risk of violence and abuse.
