Sammendrag

Avhandlingen behandler rettslige problemstillinger som oppstår i forbindelse med uskifte mellom gjenlevende ektefelle eller samboer og førstavdødes øvrige arvinger.

Opprinnelig kunne uskifteretten defineres som en rett for gjenlevende ektefelle til å beholde felleseiet udelt med felles livsarvinger. De fleste av de karakteristika som tidligere særmerket uskiftet har i dag forsvunnet. I dag kan uskifte etableres både med særlivsarvinger og utarvinger. Det er videre adgang til å avtale uskifte med særeie. Dessuten er det foreslått uskifterett for samboere. Uskifte vil fremover kunne betegnes som en rett som tilkommer gjenlevende i et livsfellesskap til å overta hele eller deler av førstavdødes formue, som sammen med hele eller deler av ens egen formue, skal utgjøre en formuesmasse underlagt særlige rådighetsinnskrenkninger, og som skal deles etter egne fastsatte regler ved uskiftets opphør. Uskifte, enten direkte i kraft av loven eller etter arvingenes samtykke, vil fremstå som en aktuell mulighet i de fleste tilfeller hvor et livsfellesskap opphører ved en av partenes død.

Til tross for grundige forarbeider, rikholdig teori, og på visse punkter omfattende rettspraksis, er det fortsatt mange uavklarte spørsmål i uskiftematerien: I avhandlingen behandles for det første uskifteinstituttets rettslige identitet, med hensyn til eierforholdene. Det drøftes hvorvidt uskifteboet er et sameie mellom gjenlevende ektefelle og arvingene, om gjenlevende ved å overta boet uskiftet blir eneeier av hele uskifteboet, eller om gjenlevende ikke er eier overhodet, men kun bruksrettshaver. Videre behandles flere uavklarte spørsmål omkring de konkrete uskiftereglene. Begrensningene i gjenlevendes adgang til å gi gaver under uskifte og uskiftereglenes gavebegrep drøftes inngående, og vurderes i lys av arvelovens regler om arveforskudd. Videre gis en inngående redegjørelse for arvingenes adgang til å kreve skifte ved gjenlevende ektefelles misbruk av uskifteboet. Det gis også en bred gjennomgang av reglene om skifte av uskifteboet, både mens lengstlevende fortsatt lever og etter hennes død. Ved samtykkebasert uskifte oppstår også flere særegne problemer. I avhandlingen drøftes blant annet hvilke vilkår som kan oppstilles for å samtykke til uskifte, og i hvilket omfang samtykkebasert uskiftet er underlagt arvelovens og avtalelovens regler.
Arveloven og dens forarbeider ble til i en tid med helt andre familiestrukturer enn i dag. Skilsmisser var langt sjeldnere enn i dag, og samboerskap var en nærmest ukjent samlivsform. Når samfunnet og de samfunnsforhold arve- og uskiftelovgivningen skal virke i har endret seg, er det grunn til å spørre seg om dagens regler er hensiktsmessige, og om de bygger på interesseavveininger som er representative for hva arvelatere, ektefeller og arvinger i dag mener bør være utslagsgivende for fordelingen av arvelateres eiendeler? I avhandlingen vurderes både hva som kan gjøres innefor rammene av uskifteordningen, og andre mulige innfallsvinkler på løsningen av avveiningsspørsmålene mellom arvelaters, ektefellens og slektsarvingenes interesser. I disse avveiningene trekkes det inn løsninger og erfaringer fra land som har vurdert gjenlevende ektefelles rettsstilling i de senere år.

Summary

The subject of this doctoral thesis is the legal issues raised by the surviving spouse’s unprobated ownership of an estate – uskifte.

Originally, uskifte could be defined as a right reserved for the surviving spouse to keep the entire community property undivided, without probate with the common lineal descendants of hers and the deceased spouse. Many of the characteristics that were originally linked to the concept of uskifte have vanished. Today, an arrangement of uskifte may be established even if the deceased spouse leaves separate offspring or if there are legal heirs other than direct descendants of the deceased.

Furthermore, an arrangement of uskifte may be established even if the spouses had separate property during the marriage. And finally, there is a bill proposing the concept of uskifte to apply also among cohabitants. In the future, uskifte may be described as a right reserved for a surviving life partner to retain the whole or parts of the deceased life partner’s estate, which together with the whole or parts of his or her own property constitutes an estate. This estate is subject to certain restrictions in dispositions, and will be distributed through a specific set of rules by the termination of the uskifte. Uskifte, either by operation of law, or by agreement, will appear as a feasible possibility in most cases where a life companionship is terminated by the death of one of the partners.

Despite the thorough preparatory works of the Inheritance Act, abundant legal theory, and a large amount on legal decisions regarding some parts of the regulations of uskifte, there are still several legal questions left unanswered: The author of this thesis discusses the legal identity of the concept of uskifte regarding the ownership of the estate during uskifte. Several alternatives are discussed here; whether the estate is in co-ownership between the surviving spouse and the heirs, whether the surviving spouse is the sole owner of the estate, or whether uskifte is merely a right of use. Furthermore, several unsettled issues concerning the specific provisions on uskifte in the Inheritance Act are discussed. The limited power of the surviving spouse to donate gifts during uskifte, and the concept of gifts in the uskifte-setting, are dealt with thoroughly. The regulation on gifts is also discussed in light of the regulations of advancement of inheritance. Another question discussed in depth is the right of the heirs to terminate the uskifte if the surviving spouse acts improperly so that the estate is unnecessarily reduced or exposed to the risk of considerable reduction. An important subject which is discussed are the regulations on distribution of the estate, both if the estate is distributed while the surviving spouse is still alive, and distribution of the assets after her death. Uskifte based on contract, raises a number of specific legal issues. The thesis also deals with which conditions may be set by the heirs in connection with consenting to uskifte, and to what extent uskifte based on contract is subject to the regulations in the Inheritance Act and the Contracts Act.
The Inheritance Act and its preparatory works are products of a time with family structures in many ways different than those of today. Divorces were rather scarce, and unmarried cohabitation was almost unheard of. Given that society in which the Inheritance Act applies has gone through such deep and profound changes, it seems reasonable to pose the question whether our present legislation on inheritance matters is still appropriate. Is the law still based on a balancing of interests that is representative for what spouses and heirs of today think should be decisive for the distribution of the deceased’s assets? Suggestions are made as to which possible changes that may be made within the limits of uskifte, and also whether there are other ways of balancing the interests of the respective parties; the deceased, the surviving spouse and the other heirs. Finally, a comparison is made between on the one hand the experiences and solutions from other countries where the legal status of the surviving spouse has been discussed by the legislature recently, and on the other hand the Norwegian system.
