As part of the larger debate on the legitimacy of the international investment regime, this paper aims to contribute to the ongoing discussion on the relevance of dissenting opinions in Investment Treaty Arbitration (ITA). By taking account of all existing dissents issued in ITA proceedings until the end of 2016, we look at some of the internal (nationality, gender, education, career) and external factors (party appointment) that might influence arbitrators’ willingness to dissent.
