PluriCourts Lunch Seminar: The Role of Systemic Interpretation in Trade and Investment Disputes

The paper considers the potential legitimacy concerns arising from the use of interpretative techniques to bring in other non-economic law into trade and investment disputes. The paper will analyse how these tribunals have dealt with article 31(3)(c) of the Vienna Convention and the line between systemic interpretation and systemic integration. How widely should 'other law' be taken into account and what does 'taking into account' really mean for these tribunals? These questions tap into the tribunal's approach to state consent to jurisdiction and potential legitimacy concerns.
