MultiRights Seminar: European Union Accession to the European Court of Human Rights
Stian Øby Johansen is a Research Assistant at the Centre for European Law at UiO. The topic of his presentation will be the European Union's accession to the European Convention on Human Rights.
After decades of discussions among scholars, bureaucrats and states, the European Union will finally be acceding to the European Convention on Human Rights. However, even prior to accession the ECtHR have had to deal with cases regarding the compatibility of EU law with the Convention. The principles applicable pre-accession have been laid out in famous cases such as M&Co, Matthews and Bosphorus. At the dawn of accession Stian will attempt to explore how the ECHR will be applied to the Union post-accession, and explore the relationship between the two courts - the ECJ and the ECtHR - post-accession.
