The State-of-the-Art in International Investment Treaty Arbitration
Postdoctoral research fellow Daniel Behn has recently published an article entitled 'Legitimacy, Evolution, and Growth in Investment Treaty Arbitration: Empirically Evaluating the State of the Art' in Georgetown Journal of International Law (vol.46, no.2, 2015).
In this article, Dr. Daniel Behn highlights the legitimacy debates on investment treaty arbitration that have developed in the recent decades.
To address legitimacy concerns, Behn assesses the evolution of investment treaty arbitration by empirically evaluating investment treaty arbitratioin cases in the last three years. A particular focus is given to the ideas of diversification and fair distribution of claims.
He concludes its analysis inviting for more scholarship pursuing empirical study in the field of Investment treaty arbitration.
