About the lecture
Due to the adoption of the AI Act, the intersection between the enforcement concerning services using AI systems and simultaniously based on personal data processing may become quite complex. However, the experience of data protection authorities (DPAs) concerning AI-based services may also be perceived as an asset and invaluable experience also in the context of enforcing the AI Act. Against this background, the talk will present the results of a study of the involvement of DPAs in enforcement concerning AI-driven services. Firstly, the results of an inquiry into the activities of DPAs concerning the AI will be presented. Secondly, the preliminary results of an in-depth study of identified decisions concerning the AI-driven services will be presented. Alongside the results of these studies, the methodological challenges associated with their implementation will be discussed. Finally, the normative consequences of the results for the enforcement systems of the GDPR and the AI Act will be discussed.
