Question from the Swedish team: The finnish team did not respond to our statement of claim - are they bound to the argumentation in their statement of defence or can they adjust their argumentation so that perhaps new circumstances are raised in order to meet our statement of claim.
- Answer: Respondents will have the opportunity to adapt their oral defences to the arguments presented in the plaintiff's statement of claims.
Questions from the Finnish team: We are to act on the behalf of the defendants against Team 1 Sweden (Aspe, Osmancevic, Gustafson). That means we will be revising our defense in view of the Statement of Claims submitted by this team. Concerning this we would like to know whether the Claimant, while preparing an oral presentation of the case, can make changes to the Statement of Claims, or should their oral presentation be based completely on their submitted Statement, according to the rules of the competition?
- Answer: A team acting as plaintiff is bound by the facts and rules on which its statement of claim was based. It is, however, allowed to present additional legal arguments in support of those rules, including additional sources of law (case law etc.).
It is also a little unclear whether we, as Defendants, are allowed to change the defense completely, or should we stick to our original Statement of Defense?
- Answer: Respondents are not allowed to change their defence completely, but will have the opportunity to adapt their arguments as far as it is necessary to rebut the arguments presented in the plaintiff's statement of claims.
Are we expected to submit any written work in connection to the final round, or will the oral preparations suffice?
- Answer: The Court's evaluation will be based on the oral presentations (in addition to the statements of claim and written defences), and the judges are not expected to read additional material. The teams may, however, use written skeletons, graphics etc. to support their oral presentations.
