Research Methods in Contract Law and Scholarship

Research Methods in Contract Law and Scholarship explores the multifaceted nature of modern contract law and practice. The sources of law are based on open textured principles and rules. Pressing problems of the law can only be resolved by looking over the boundaries that divide the law and discovering the underlying entities.  The sources of contract law open up for taking account of principles that provide the systemic cohesion much needed to achieve the certainty and predictability on which contract law depends.

The book identifies the various modes of inquiry and argumentative techniques in this dynamic field, providing theoretical depth and practical tools for legal scholarship. Chapters focusing on doctrinal, comparative, philosophical, historical, economic, empirical, and experimental approaches are complemented by discussions of the research methods most apt for dealing with phenomena that challenge traditional conceptions of contract law: sustainability, digitalisation, consumer protection, Indigenous legal orders, and globalisation. Ultimately, the book eschews any predetermined agenda in favour of a particular theory, inviting researchers to reevaluate their modes of enquiry and reasoning.

The event will give an opportunity to meet and discuss research methods in contract law with editors Professor Yuliya Chernykh and Professor Mads Andenas who also will address the issues in his chapter (on comparative law), as will Johan Wibye (philosophical perspectives on contract law), Mitja Kovac (law & economics), Sergio Mittlaender (experimental methods in contract law) and Monika Leszczynska (empirical methods in contract law). The event will be opened by Johannes Hygen Meyer.
