About the project

The thesis addresses the obligations and rights established for undertakings, the authorities, and others by a legally binding decision under eight provisions – the Norwegian Competition Act §§ 12 third paragraph and 16 second paragraph, ODA Protocol Chapter 4 Article 9 and Chapter 4 Article 6(2) and 8(2), Regulation 1/2003 Article 9, and Regulation 139/2004 Article 6(2) and 8(2).

Goals

The objective of the thesis is to determine what these obligations and rights can and should entail. To the extent that there is a difference between the two, corrective measures will be proposed. In this regard, a hypothesis will be tested regarding whether the format of the decision provides obligations and rights of the same nature. Additionally, it will be assessed whether the rules contribute to the effective public enforcement of Norwegian and European competition law.
