About the project

The project concerns termination agreements in employment relationships. A termination agreement is a mutual agreement between the two parties in an employment relationship – the employer and the employee – which has as its purpose to terminate the employment relationship. This represents an alternative method to terminate an employment relationship to those regulated by the Working Environment Act, i.e. unilateral termination or dismissal. Termination agreements are an accepted and common way to end an employment relationship.

I will particularly discuss how statutory invariable protection rules impact the rules regarding the formation, content, and completion of termination agreements. The rules concerning termination agreements may be derived from various legal bases, particularly invariable protection rules and general contract law. In the thesis, I will formulate, discuss, and answer various legal questions related to the formation, content, and completion of termination agreements to address this overarching research question.

Goal

The overarching research question is how mandatory protection rules affect the rules regarding termination agreements. The purpose is to clarify the relationship and interaction between employment law and general contract law. The thesis specifically concerns termination agreements, but discussions on this relationship and interaction will also be relevant for other types of agreements entered into in areas where statutory invariable protection rules exist. Therefore, my ambition is to contribute research also to general contract law.
