Bangladesh and the International Refugee Law Regime

This project analyses how major refugee hosting state like Bangladesh interprets International Refugee Law, despite being non-signatory to the 1951 Refugee Convention.

About the project

This project concerns Bangladesh's practice of international refugee law (IRL), considering its status as non-signatory to the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol.

Bangladesh hosts one of the world's largest refugee populations. Yet, its adaption international refugee law, and historical development of refugee policies remain understudied compared to other South Asian states.

This research project will investigate how Bangladesh interacts with the International Refugee Law regime by studying state practice.

Objectives

The overall objective of this project is to assess Bangladesh works as an actor in shaping international refugee law. The project furthers knowledge the areas discussed above in three aspects:

  1. To find out the essential factors of non-adherence to 1951 Refugee Convention by Bangladesh.
  2. How and in what ways, even not being a signatory to the 1951 Refugee Convention and its 1967 Protocol, Bangladesh claims to be in compliance with the international refugee law?
  3. How far the refugee policies and judicial mechanisms in Bangladesh addresses the IRL norms and standards?

Method

This project is a socio-legal study, involving both doctrinal legal research, empirical field research and archival research.

Project period

This project will run for three years starting August 2022.

Financing

The project is part of the research project "BEYOND" and is funded by the European Union's Horizon 2020 research and innovation programme under grant agreement No 851121 (ERC Starting Grant 2019).
