Marius M. Kjølstad holds a Master’s in Law from the University of Bergen (2019) and an LL.M. in Legal Theory from the Goethe-Universität in Frankfurt am Main (2019). In 2024 he obtained a PhD at the Faculty of Law, University of Bergen, on the dissertation “Political Teleology. Some Chapters on the Purpose of the State in Norwegian State Doctrine ca. 1800–1866”. He has worked at the Department of Public and International Law since 2024.

This article provides an overview of the reception of Paul Johann Anselm Feuerbach’s criminal law thinking in Norwegian criminal law science from about 1800 until today. Feuerbach, who is celebrated in 2025 on the occasion of his 250th anniversary, has had a significant impact on the development of Norwegian criminal law, although this has varied considerably over time. The article shows how Feuerbach became a crucial point of reference in the first half of the 19th century, mediated through the writings of the Danish jurist Anders Sandøe Ørsted, and that Feuerbach’s theories on punishment underpinned the Criminal Code of 1842. In the 20th century, Feuerbach remained present in criminal law discourses, but to a lesser degree. In recent years, the discipline has seen a revival of theoretical and normative orientations in general, and Feuerbach again receiving more attention from some scholars. The article concludes by suggesting that future research projects combining historical and theoretical perspectives could potentially also disclose whether there are more ‘hidden’ influences from Feuerbach in Norwegian criminal law.

Forvaltningslovutvalget har forsøkt å utforme taushetspliktsreglene i sitt lovforslag slik at innsynsretten etter Den europeiske menneskerettskonvensjonen (EMK) artikkel 10 kan sikres på en god måte. Drøftelsen av artikkel 10 er imidlertid knapp, og forslaget til unntaksbestemmelse i § 36 andre ledd bokstav d er ikke egnet til å oppnå sin hensikt. Artikkelen argumenterer for at det bør gjøres grundigere vurderinger av spørsmålet i den videre lovgivningsprosessen, og gir samtidig en oversikt over nyere rettspraksis.

Overall, the aim of this book is to enhance the reader’s understanding of the historical embeddedness and unique nature of each legal culture. In addition, it provides a more holistic and sophisticated understanding of the legal culture in question. Such a deeper understanding of legal cultures can be valuable, even essential, as a point of departure for conducting all kinds of legal comparative studies, on the macro6 as well as on the meso and micro level. Legal cultural knowledge and understanding can help ask the right questions and choose a proper methodological approach suitable for the individual purpose and object of a comparative study. Fundamentally, it provides us with a tool to critically check our assumptions and put empirical observations into context. We aim to enhance the readers’ ability to think and argue critically and reflectively, not only when encountering foreign lawyers, legal systems, and laws, but also regarding their own national legal cultures. In a constantly more pluralistic and internationalised (legal) world this is a skill crucial for both contemporary and future lawyers in a struggle to compete with the astonishingly fast developing faculties of AI
