New book: “The Transnational Law of Renewable Energy”, Sourgens, Baldwin and Banet (OUP, 2024)

About the Book:

An important part of the latter task is to accompany by law the achievement of the ambitious renewable energy goals set at national and regional level and pushed by climate commitments, through de-risking cross-border renewable energy projects.

The increased role of renewable energy is impossible without ‘derisking’ renewable energy projects on a global basis. Derisking global RE projects is a governance task for lawyers and not just a task for economist and policy-makers. Lawyers in all capacities create the legal frameworks in which RE projects can be planned, financed, built, interconnected, operated, and regulated.

This book is about taking a first stab at the progressive development and codification of this transnational law of renewable energy. There is a critical mass of cross-boundary projects and projects with project sponsors from a jurisdiction other than the host state to the project from which one can develop a set of guidelines that can work to derisk the governance framework for RE projects and value chains in general. The value chain for renewable energy projects requires considering the supply of technologies and materials from various jurisdictions, and their financing, installation, and operation require the involvement of international skills. Even local renewable energy projects will need to consider transnational law to some extent. Cross-boundary renewable projects, such as offshore wind and  energy hubs, genuinely require the application of rules—existing or to be shaped—of a transnational character.
