The Israel-Palestine war and its consequences for the international legal order

In the wake of the 7 October events, where Hamas launched an attack on Israel, and Israel responded with massive bombardment and a ground invasion campaign on the Gaza strip, the discussions on the application of International Humanitarian Law and Human Rights to the situation of Palestine have intensified. Terrible atrocities have been unfolding against civilians. What are the legal implications of the recent events?

Hamas infiltrated the Israeli separation wall and broke through the border crossing between Gaza and Israel on Saturday 7 October, killing about 1,200 people and taking more than 200 hostages. Subsequently, Israel declared war and retaliated with a massive military offensive. As the Gaza Strip is under intense Israeli bombardments and a continued blockade, the death toll among the Palestinian population has risen quickly to over 14,500 killed, and the escalation of hostilities in the Gaza Strip has had a catastrophic impact on children and families. About 6,000 children and 4,000 women have reportedly been killed and thousands more have been injured. Additionally, 1,5 million people are forcibly displaced in Gaza (UNRWA update).

This event aims to shed light on key legal issues surrounding armed conflict and military occupation, with a specific focus on comprehending the dynamics of the ongoing situation between Israel and non-state armed movements such as Hamas. As claims and justifications of serious breaches of international law have spiked, legal definitions of terms like 'war crimes', ‘genocide’, ‘right to self-defence’ and ‘collective punishment’ and their implications in the context of international law will be highlighted.

Join us to learn more about the application of international law in the aftermath of the most recent escalation of the conflict, and hear the debate on whether international law can contribute to advancing peace.
