“The research examines the legal dimensions of overtime pay for part-time workers in the EU and EEA, with a focus on whether the lack of recognition of overtime pay below full-time thresholds constitutes indirect discrimination against women, who represent the majority of part-time employees, as well as, less favourable treatment in comparison with full-time workers. Through a doctrinal analysis of EU primary law, the Charter of Fundamental Rights, ILO Convention No. 100, and EU secondary legislation such as the Part-Time Work Directive and the Equal Treatment Directive, the study situates recent CJEU case law, particularly Joined Cases C-184/22 and C-185/22, within the evolving framework of equality and labour rights. These judgments clarified the interpretation of the aforementioned rules and highlighted the challenges of proving indirect discrimination through both qualitative and statistical means, while leaving considerable discretion to national courts. The thesis further evaluates the EEA dimension, assessing how obligations stemming from EU equality law, incorporated through Annex 18 of the EEA Agreement, apply to Norway and other EFTA States. Finally, it considers the tension between EU and EEA minimum standards and national autonomy in labour market regulation, the implications for the Nordic Model, and the long-term impact on pension outcomes, including the potential role of predictive modelling in evidencing structural disadvantage.”
