Bakgrunn

I 2008 kom Mads Andenæs tilbake til Det juridiske fakultet hvor han siden har vært professor i rettsvitenskap, og har undervisningsansvaret for fagene selskapsrett, finansmarkedsrett, sammenlignende privatrett og menneskeretter. Han leder forskningsprosjektet "Internasjonal finansmarkedsregulering, institusjoner og effektivitet".

Andenæs var 2009-2015 en av FNs "Human Rights Mandate Holders" og medlem av FNs arbeidsgruppe for vilkårlig fengsling, og var i en periode leder av FN-arbeidsgruppen og FNs spesialrapportør om vilkårlig fengsling. Vervene var ulønnede. Han har vært advokat i flere saker, inkludert ulønnede/pro bono oppdrag for Redd Barna, NOAS og ubemidlede flyktninger og andre som ikke har annen adgang til advokathjelp. Hans studenter har bistått f eks i Trandum-saken der Borgarting lagmannsrett ga fastsettelsesdom for brudd på grunnloven, menneskerettskonvensjonene og oppreisning til en afghansk familie med fire barn som hadde vært fengslet på Trandum i 2014. Dommen ble ikke påanket og er rettskraftig. 

Han var direktør for det British Institute of International and Comparative Law i London (1999–2005). Før det var han ved King's College, Universitetet i London, i en årrekke som direktør for Centre of European Law (1991–1999). Han har også vært Senior Fellow ved Institute of European and Comparative Law, Universitetet i Oxford, og fortsetter denne tilknytningen som Visiting Fellow, og dessuten til Institute of Advanced Legal Studies, Universitetet i London som Senior Research Fellow.

Han har erfaring fra norsk sentralforvaltning, først som byråsjef for Juridisk Kontor i Handelsdepartementet 1985–1986, og som byråsjef, underdirektør og avdelingsdirektør i Finansdepartementets økonomiavdeling 1986–1993.

Han har dessuten vært Legal Adviser i the European Bank for Reconstruction and Development (EBRD), London, med særlig ansvar for EBRDs lovreform-prosjekter i de tidligere kommunist-statene. Han har vært konsulent for Verdensbanken og Det internasjonale pengefondet (IMF). Han har vært Fulbright Fellow ved Columbia University i New York.

Han er cand jur fra Oslo, PhD fra Cambridge og MA og DPhil fra Oxford. I studietiden var han leder for Studentparlamentet ved Universitetet i Oslo, leder for (den norske) Foreningen Nordens Ungdom, og leder for (den nordiske) Foreningene Nordens Ungdomsforbund og satt i flere år i (den norske) Foreningen Nordens Hovedstyre og (den nordiske) Foreningene Nordens Presidium. Han satt i Fellesrådet for det sørlige Afrika, i det første styret for Norsk forening for asylsøkere (NOAS), i styret for Framfylkingen og fire år i AUFs sentralstyre.

Han har vært gjesteprofessor ved Universitetet i Roma La Sapienza (fra 2002), Université Libre de Bruxelles (Chaire W J Ganshof van der Meersch under the Fondation Philippe Wiener–Maurice Anspach), Roma Tre Universitetet, SciencesPo (Chaire Vincent Wright), Paris og Paris I (Sorbonne). I 2005 var han Fellow of Netherlands Institute for Advanced Study in the Humanities and Social Sciences (NIAS, som ‘Guest of the Rector’). I 2006 holdt han den årlige Guido Carli-forelesningen på LUISS-universitetet Guido Carli i Roma. I 2008–9 holdt han en seminarrekke på École normale supérieure i Paris om menneskerettigheter og rettsammenligning. Han har også tilbrakte flere perioder ved Humboldt-universitetet i Berlin. I 2016 var han Visting Fellow ved All Souls College, University of Oxford.

Blant forskjellige verv kan nevnes: Secretary General of the Fédération internationale de droit européen 2000–2002, Honorary Secretary of the United Kingdom Association of European Law 1997–2008, Honorary Secretary of the United Kingdom Committee of Comparative Law 1999–2005, styremedlem og senere leder av Norsk forening for europarett og styremedlem i Norsk forening for internasjonal rett, Chair of the Association of Human Rights Institutes (AHRI, 2009), medlem av the International Law Associations Securities Law Committee (fra 1996), og medstifter av og styremedlem i den norske avdelingen av the International Commission of Jurists (2008–9).

Han er Honorary Fellow of the Society of Legal Studies (UK), Fellow of the International Academy of Commercial and Consumer Law, og Fellow of the Royal Society for Arts (FRSA).

Han har publisert mer enn 50 bøker og er redaktør av flere tidsskrifter og bokserier. Som forsker har han i de senere årene arbeidet med folkerett, menneskeretter, finansmarkedsregulering, EUs indre marked og gjennomføringen av europeiske og internasjonale forpliktelser i nasjonal rett (også erstatningsrettslige og andre sanksjonsregler). I tillegg har han presentert arbeider om domstolenes uavhengighet, minoritetsrettigheter, personvern og ny teknologi, og bruken av forholdsmessighetstandarder i nasjonal, europeisk og internasjonal rett. I sin egen forskning i de neste fire årene planlegger han å fokusere på disse gjennomføringsspørsmålene, forholdet mellom politiske beslutningsprosesser og rettslig vern for individuelle rettigheter. Han vil også fortsette sitt arbeid i europeisk privatrett og selskapsrett.
