  This chapter explores how human rights advocacy may contribute to skewing the project of international criminal justice against its liberal ambitions. In holding states accountable for human rights abuses, human rights NGOs advocate on behalf of defence rights; in holding individuals accountable for human rights abuses, human rights NGOs advocate on behalf of victims. The chapter delves into popular appeals on behalf of victims of international crimes and explores the concurrent stigmatization of defendants in international criminal justice. The chapter suggests that there is a lack of structural restraints on the call to ‘do justice’ at the international level, and that those that often play a major role in restraining criminal justice at the domestic level – human rights organizations – are in the driving seat of expanding criminal justice solutions at the international level and in transitional justice.

  In this chapter, we reflect on the contributions of this book and on the meaning of different temporalities in transitional justice through the prism pro vided by the sociology of time. By critically addressing the relationship between various conceptions of justice and different actors’ and constituencies’ experiences of time and its meanings following mass violence, our purpose is to take a constructive look at some of the fundamental premises of transitional justice in the aftermath of terror attacks in democratic societies. In doing so, we caution against a normative expectation to “leave the past behind” and propose a humbler approach to the relationship between time, justice, and mass violence.

  Etter 22. juli. Overgangsrettferdighet og terror handler om hvordan det norske samfunnet har forsøkt å forstå, svare på og finne veier videre etter 22. juli-angrepene i 2011 – i og utenfor rettsapparatet. Den 22. juli 2011 bombet en terrorist det norske regjeringskvartalet før han utførte et massedrap på AUFs ungdomsleir på Utøya. 77 personer ble drept, og framtiden ble endret for tusener av andre. 15 år senere undersøker bidragsyterne i denne boken rettferdighetens rammer etter terrorangrepene og ulike former for oppgjør, forsonings- og minnearbeid i tiden som har gått. Boken tar utgangspunkt i forskning på overgangsrettferdighet, og gjennom analyser av rettsprosesser, granskningskommisjoner, politiske holdninger, ulike former for minnearbeid, statens ansvar for borgernes frihet og sikkerhet og tidens betydning, viser boken hvordan overgangsrettferdighet kan forstås etter terror. Boken er en av tre bøker som beskriver ulike ringvirkninger i etterkant av 22. juli 2011, som resultat av forskningsprosjektet LAW22JULY: RIPPLES.

  This chapter examines how justice norms and crime control models travel around the world, and the Global South’s role in global, supranational, and transnational criminology. We argue that the Global South has exercised more agency than it has typically been credited with in contributing to, initiating, and contesting international justice and transnational crime control. Internationally, global justice norms and policies have been primarily shaped by Global North countries, yet this chapter shows how Global South countries have engaged in contestation, struggle, and alternative worldmaking in the development of these international justice regimes. Transnationally, the travel of crime control models has tended to occur through the foreign policies of Global North countries, yet the chapter problematizes these processes of “diffusion” and “translation” and highlights the contested nature of Global North-South interactions. Finally, we reflect on the implications for global criminology of the Global South’s changing role amid shifting global power dynamics, as the liberal global order fragments and gives way to multipolarity.

  In times of political crisis and attacks against the foundations of political liberalism, can we put our trust in lawyers and other legal occupations to fight for our freedoms when they are under attack? The role of the legal profession in the rise, development, and resilience of political liberalism has been at the core of a body of work commonly framed as “the legal complex”: Terence C. Halliday and Lucien Karpik’s Lawyers and the Rise of Western Political Liberalism, Halliday, Malcolm Feeley, and Karpik’s Fighting for Political Freedom, Halliday, Karpik, and Feeley’s Fates of Political Liberalism in the British Post-Colony, and Feeley and Malcolm Langford’s The Limits of the Legal Complex. In view of the precariousness of political liberalism in contemporary global politics, this review essay reflects on the core ideas of the legal complex literature. By identifying connections with other strands of scholarship on legal agents, legal mobilization, and the move to law in transitional politics, I suggest rescaling the study of the legal complex to enable consideration of its relevance for the study of political liberalism at the international level of analysis and, specifically, of its importance to the resilience of the liberal international order currently in rapid decline.

  The rising tide of autocratization does not bode well for the International Criminal Court (icc), which has almost exclusively intervened in contexts of autocratic rule. As the Court is dependent not only on state cooperation but also on non-governmental organizations (ngo s) for effectiveness and legitimacy, this article explores the role—if any—of dissident ngo s in the pursuit of justice for international crimes committed under autocratic regimes. It shows that, while ngo s have been fundamental to the working of the icc, autocratic states are particularly challenging for the icc and ngo s to operate in. Despite this, ngo s may have found new ways of holding autocratic states to account for international crimes—with or without the icc.

  To contribute to the development of an international sociology of punishment, this chapter offers an analysis of penal power when it is detached from its association with national justice and enters the realm of the international. Specifically, the chapter contributes a comparative analysis of Nordic discourses driving penal power in two overlapping yet nonetheless distinct areas of transnational concern – namely the field of international criminal justice, and the prosecution of foreign fighters. It argues that whereas a humanitarian discourse drives the Nordic engagement in the larger field of international criminal justice, the discourse on foreign fighters is characterized by ‘securitization’– transforming the prosecution of international crimes into a matter of national security. As such, the analysis raises interesting questions about penal logics in international politics, and about how penal power beyond the nation state remains receptive to securitization in spite of political support for an international system of criminal justice.

  Mens de straffe- og sikkerhetsrettslige aspektene ved terrorangrepet 22. juli 2011 har vært grundig belyst i sakprosa og faglitteratur, har rettens mer generelle rolle i møte med 22. juli ikke blitt gjenstand for samme oppmerksomhet. Denne artikkelen skisserer en rettssosiologisk forskningsagenda ved å kartlegge de rettslige virkningene av 22. juli i lys av rettens møte med overlevende, minnearbeid og gjenoppbygging. Vi viser hvordan den norske staten og rettsapparatet i all hovedsak ser ut til å velge ordinære virkemidler i respons til det ekstraordinære 22. juli. Vi er interessert i hvordan retten fordeler ressurser og overprøver offentlige inngrep i sin reaksjon på 22. juli, og hvordan ulike aktører setter retten i spill i kampen om den autoritative fortellingen om 22. juli. På tross av at rettsliggjøring og rettslig mobilisering kan styrke rettigheter, viser våre foreløpige analyser at rettsliggjøringsprosesser også bidrar til å konsolidere sosiale og politiske konfliktlinjer, og kan vanskeliggjøre forsoningsprosesser i etterkant av 22. juli. Således er artikkelens formål å bidra til økt forståelse av rettens og rettssosiologiens rolle i møte med ekstraordinære hendelser og av 22. juli som en rettslig begivenhet med konsekvenser for det norske samfunnet.

  By their ability to ‘shock the conscience of humanity’, core international crimes – war crimes, crimes against humanity, and genocide – are instilled with a ‘higher’ victim profile than what is generally the case in domestic criminal justice. While the permanent International Criminal Court – as an embodiment of the international community – have been delegated the authority to punish on behalf of its member states, this chapter moves beyond such a politico-legal approach to offer a cultural insight into the ‘global’ authority to punish, asking, who are the ‘we’ who punish? Drawing on empirical research from the author’s study of human rights advocacy at the ICC and conceptual work that is the legacy of Emile Durkheim, the chapter explores how the notion of ‘humanity’ is put at the centre of international criminal justice’s moral foundation, and does work to justify criminal punishment when it is disembedded from the nation state. As such, the chapter suggests that international criminal justice serves, in the name of humanity, to reinforce a cosmopolitan imaginary of a global moral order, albeit one that is, in its current manifestation, biased, selective and situated.

  Solitary confinement in prison and police detention has been a widespread criminal policy and human rights problem in the Scandinavian countries for decades. However, in recent years, there has been a significant legal mobilization in Norway whereby lawyers individually and collectively have challenged solitary confinement in the courts. This use of strategic litigation has been directed towards solitary confinement in police custody, remand and during imprisonment. Based on qualitative interviews and documents, we analyze the organizational and legal strategy behind this legal mobilization, along with its effects and preconditions. We find that strategic litigation by lawyers has played an important role in the struggle against solitary confinement in Norway, but that it has benefited from – and played in tandem with – a legal and political opportunity structure consisting of national as well as international actors, processes, and legal frameworks. These findings raise the question of whether lawyers and civil society can contribute in similar ways in the other Scandinavian countries.

Analysens første del tar for seg den internasjonale strafferettens strukturelle betingelser, med særlig fokus på den geopolitiske og historiske plasseringen av det internasjonale strafferettsfeltet i den liberale verdensordenen. Deretter identifiseres de globale «entreprenørene» bak ICC, det vil si transnasjonale nettverk av menneskerettighetsaktivister, rettsaktivister og ikke-statlige organisasjoner, før fokuset snevres inn på individene og institusjonell makt i det internasjonale strafferettsfeltet. Ved å stille spørsmål om hvem det er som «gjør» internasjonal strafferettferdighet i det daglige, viser artikkelen hvordan misforhold og skjevheter i det internasjonale strafferettsfeltets betingelser og sosiale strukturer slår uheldig ut for den internasjonale strafferettens normative forankring i det «globale» samfunnet. Avslutningsvis diskuteres spørsmålet om hva ICCs legitimitetsproblemer betyr for domstolens fremtid, og hvordan begreper som «krise» også åpner for kritisk potensial.

  The edited volume develops the concept of extraterritorial crime control to make sense of the nexus between criminal justice, foreign affairs and international relations. By extraterritorial crime control, we mean the ways in which states and international organisations project and deploy criminal justice tools, institutions and norms beyond their territorial borders in order to govern, discipline or strategically shape other sovereign spaces. The extraterritorial lens enables us to see the strategic and often asymmetric ways in which criminal justice is mobilised and exported.   Etter 22. juli. Overgangsrettferdighet og terror handler om hvordan det norske samfunnet har forsøkt å forstå, svare på og finne veier videre etter 22. juli-angrepene i 2011 – i og utenfor rettsapparatet. Den 22. juli 2011 bombet en terrorist det norske regjeringskvartalet før han utførte et massedrap på AUFs ungdomsleir på Utøya. 77 personer ble drept, og framtiden ble endret for tusener av andre. 15 år senere undersøker bidragsyterne i denne boken rettferdighetens rammer etter terrorangrepene og ulike former for oppgjør, forsonings- og minnearbeid i tiden som har gått. Boken tar utgangspunkt i forskning på overgangsrettferdighet, og gjennom analyser av rettsprosesser, granskningskommisjoner, politiske holdninger, ulike former for minnearbeid, statens ansvar for borgernes frihet og sikkerhet og tidens betydning, viser boken hvordan overgangsrettferdighet kan forstås etter terror. Boken er en av tre bøker som beskriver ulike ringvirkninger i etterkant av 22. juli 2011, som resultat av forskningsprosjektet LAW22JULY: RIPPLES.

  Criminal justice is an integrated—but underexplored—dimension of states’ foreign affairs. Criminologists have studied the widening net of global crime governance as part of the liberal international project, where efforts to fight transnational and international crimes and insecurities while promoting penal reform in the Global South have dovetailed liberal universals of human rights, rule of law, democracy, and development (Lohne 2019; Russo and Stambøl 2022; see also Cohen 1982). Today, due in part to seismic geopolitical shifts, the liberal international order underpinning these discourses, and their practices are in rapid decline (Goddard et al., 2024; Lake et al., 2021). Crime, Justice, and Foreign Affairs is a forthcoming volume that explores the relationship between criminal justice and notions of order-making beyond territorial sovereignty: How do crime control policies, practices, logics, and technologies of crime governance factor in the foreign policy toolbox? How is criminal justice part of states’ external logics and manifestations of sovereign power—and their efforts to contribute to global order-making? By offering a set of original empirical analyses of the “external” logics of crime governance from a diverse set of authors from around the world, the book seeks to advance criminological knowledge on how penality fares outside the territorially bounded nation-state order of analysis. Such a rescaled focus on order and order-making represents a new direction in criminology, which despite its fixation on social order, has by and large taken international order for granted.

  To address regional development, political and conflict issues in the Global South, Global North donors have engaged in police reform and sent police officers through foreign aid since the 1990s. While donors generally agree on democratic policing and principles of human rights, there is little consensus on how these norms are implemented (Ellison & Pino, 2012, p. 2), especially when applied to different histories and contexts (Watson & Kerrigan, 2018). Scholars have shown that such policing model and their exports have failed to establish democratically response and locally accountable policing (Blaustein, 2015; Ellison & O'Reilly, 2008; Ellison & Pino, 2012). But less is know about the origin of these exports situated in foreign aid projects from the Global North. We take a closer look at foreign data from 2000 to 2022, from three relatively generous donors considering aid per capita, namely Sweden, Denmark and Norway. Our data shows the variety of project themes, actors involved and geographical location, that together illustrates who gets funded, where, when and topic priorities of donors.

  ​While the criminal law and security governance aspects of the July 22 terror attack in Norway have been extensively analyzed in the academic literature, much less attention has been given to processes involving civil law, legal mobilization and legal-bureaucratic processes. ​The slow workings of the law mean that the aftermath of July 22 is still unfolding in different legal processes. This PRIO paper carves out a socio-legal research agenda intended to bridge the aforementioned knowledge gap. In so doing, it identifies various aspects of how the law deals with survivors, their families and the bereaved. It also addresses the legal debates over memorials and the reconstruction and securitization of the Norwegian Government Quarter. We argue that in choosing between extraordinary and ordinary legal mechanisms and instruments to deal with the terror attack, the state and the legal system have opted for the latter. This emphasis on “ordinary law” must be investigated. We are interested in how law distributes resources, rights and identities and sets limits on government interventions – and how individual actors and organizations mobilize the law to shape the political, popular and legal narratives around July 22.

  Sammendrag Hvert år blir tusenvis av barn født inn i krig. Noen av dem står enda nærmere konflikten enn andre: De blir til når en soldat eller et medlem av en væpnet gruppe på motpartens side får et barn med en lokal sivilist, vanligvis en kvinne, midt i en væpnet konflikt. I forskningen omtales de som «barn født av krig» (CBOW). Disse barna har én forelder på «fiendens» side og én forelder med røtter i det lokale samfunnet. Denne avhandlingen utforsker juridiske og personlige fortellinger om og fra denne lite studerte gruppen. Gjennom analyse av juridiske kilder og livshistorier undersøker den hvordan barn født av krig blir forstått, beskrevet og anerkjent, og hvordan krigen setter spor gjennom hele deres livsløp. Prosjektet bidrar til forskningen om CBOW samt til bredere debatter om kjønn, offerrolle, seksuell vold og grensene for internasjonal strafferett. Ettersom CBOW i økende grad fremstår som rettssubjekter i internasjonal og nasjonal rett, gir denne detaljerte redegjørelsen for deres anerkjennelse verdifulle teoretiske og praktiske bidrag. Trusler eller ofre? Gjennom historien har den dominerende fortellingen om CBOW fremstilt dem som en trussel. Denne fortellingen finnes mange steder der CBOW bor, blant annet i landene som inngår i denne studien: Tyskland og Norge, Bosnia-Hercegovina (BiH) og Den demokratiske republikken Kongo (DRK). Fortellingen om CBOW som trusler kommer tydelig til uttrykk i uttrykk som «fiendens barn», som fremstiller dem som utenforstående og som en potensiell fare for lokale eller nasjonale fellesskap. Følgelig opplever mange CBOW diskriminering og sosial ekskludering mens de vokser opp. I nyere tid har det vokst frem en ny fortelling om CBOW som ofre, delvis fremmet av CBOW selv. De motstridende fortellingene om CBOW som henholdsvis trusler og ofre, og hvordan dette har formet anerkjennelsen av dem i lovgivningen og utenfor, står sentralt i avhandlingen. Dette gjenspeiles i hovedforskningsspørsmålet: Hvordan har fortellinger om anerkjennelse og manglende anerkjennelse av CBOW utviklet seg, og hvilken betydning kan CBOWs egne perspektiver ha for hvordan de anerkjennes? Spørsmålet undersøkes gjennom juridiske kilder, dokumenter og intervjumateriale, kombinert med juridisk og narrativ analyse. Nasjonale variasjoner Utviklingen i anerkjennelse av CBOW varierer betydelig mellom land. I Norge og Bosnia-Hercegovina har CBOW organisert seg kollektivt for å oppnå juridisk anerkjennelse, om enn med varierende resultater. I Tyskland har CBOW ikke engasjert seg i kollektive tiltak for juridisk anerkjennelse, men har arbeidet for andre former for synlighet og offentlig anerkjennelse. I Den demokratiske republikken Kongo (DRK) har CBOW heller ikke mobilisert for juridisk anerkjennelse, men har likevel oppnådd det. I 2021 anerkjente Den Internasjonale straffedomstolen (ICC) for første gang i internasjonal rettshistorie, CBOW i DRK som ofre for internasjonale forbrytelser. Dette ble fulgt opp av en ny avgjørelse fra i 2024, der ICC anerkjente ugandiske CBOW som ofre for internasjonale forbrytelser. Det er særlig innenfor internasjonal strafferett at den juridiske anerkjennelsen av CBOW har fått gjennomslag de siste årene. Avhandlingen undersøker derfor internasjonal strafferett i lys av CBOW, kombinert med kvalitative analyser av intervju- og dokumentasjonsmateriale fra de nevnte casestudiene. Risikoer ved anerkjennelse og behovet for nyansering i fortellingen analysen av rettskilder viser hvordan domstoler kan bidra til å reprodusere stigma selv når formålet er å anerkjenne skade. Et eksempel er fremstillingen av CBOW som «ofre for sin egen unnfangelse». Rettslig anerkjennelse kan dermed både virke styrkende og bidra til å videreføre eller forsterke forestillinger om den den søker å beskytte. For å forhindre en slik forvrengning tyder funnene på at den rettslig relevante skaden som CBOW har lidd, må forstås bedre. Dette argumentet utdypes gjennom analyser av intervjumateriale fra CBOW født under andre verdenskrig i Tyskland og Norge, samt på 1990-tallet i Bosnia-Hercegovina. Materialet gir en rik beskrivelse av livserfaringene til flere generasjoner av CBOW og tilfører narrative nyanser til forståelsen av skade og skyld slik CBOW selv opplever dem. Intervjuene utfordrer stereotypier og synliggjør den livslange kompleksiteten ved å vokse opp med en identitet splittet på tvers av konfliktlinjer. Samlet sett foreslår avhandlingen en offerfokusert sosiologisk-juridisk redegjørelse for CBOW. Tilnærmingen bidrar til å belyse teoretiske, empiriske og praktiske «gåter» og forskningshull i den eksisterende litteraturen. Disse bidragene er relevante og aktuelle, ettersom anerkjennelsen av CBOW er et tema som i økende grad kommer til syne i juridisk praksis og i forskningen.
